Pre-Purchase and Post-Purchase Inspection Terms and Conditions

By booking a pre-purchase or post-purchase inspection through National Auto Service PTY LTD, you agree to the following terms and conditions that relate to this service:

Fees, Cancellation and Exclusions

  1. In consideration of National Auto Service PTY LTD providing the vehicle inspection report, you agree to pay the fees as laid out on our website booking portal or as discussed by one of our team members over the phone. These fees are as following:
    1. Gray’s Retail Pre-Purchase Inspection (light vehicles)- $229.00 AUD: this category applies to all regular vehicles valued under $39,999 AUD, either for private sale or those on auction at sites such as Gray’s online
      • If the vehicle is listed on an auction or private sale site for lower than market value, where the vehicles market value is currently $40,000 + AUD, the high-performance inspection price of $299.00 applies. The vehicles market value is to be researched and calculated by the customer before selecting the appropriate fee category. National Auto Service PTY LTD has the right to request the additional funds before going ahead with the inspection or before providing the completed report. The customer may either pay the difference or cancel the inspection (within the cancellation policy as listed below).
    2. High Performance Vehicles ($40,000+)- $329.00 AUD: this category applies to all vehicles valued over the price of $40,000 AUD, either for private sale or those listed on auction at sites such as Gray’s online.
    3. Classic (20 + years in age)- $329.00 AUD: this category applies to all vehicles that are over 20 years old (1999 model vehicles or earlier)
    4. Commercial (non-standard driving licence)- $579.00 AUD: this category applies to all vehicles that require a heavy-vehicle specialised licence OR those vehicles that exceed 4.5 tonnes gross vehicle mass (GVM).
    5. Additional Points:
      • It is the sole responsibility of the customer to select the correct pricing category.
      • If the incorrect pricing category is selected the difference in funds must be paid by the customer to National Auto Service PTY LTD before the inspection is booked in and completed. For example, if the regular pre-purchase inspection category at $229.00 is selected for an inspection on a high-performance vehicle valued at $40,000 or more, then the customer is required to pay the difference of $120.00 AUD, before their inspection will be booked and carried out.
      • National Auto Service PTY LTD has the right to cancel any and all bookings on the basis of incorrect selection of price category.
      • National Auto Service PTY LTD will attempt to contact the customer with the provided details at time of booking. If the customer provided incorrect details or the customer is unreachable and does not respond to phone call, National Auto Service PTY LTD has the right to hold the report until the difference in price is paid.
  2. Pre-purchase and Post-purchase inspections performed by National Auto Service PTY LTD are non-refundable once complete. In the event that National Auto Service PTY LTD is unable to complete the inspection, a refund will be issued, however once the inspection is completed, you are beholden to all relevant fees.
  3. National Auto Service PTY LTD requests that customers provide no less than 24 (twenty four) hours notice of customer intention to cancel a booking. In the event that a customer cancels a booking equal to or more than 24 hour’s notice the customer will be entitled to a full refund. However, in the event a customer cancels a booking with under 24 hours’ notice, National Auto Service PTY LTD reserves the right to charge a cancellation fee. If the inspection has already been completed National Auto Service PTY LTD reserves the right to not issue a refund and will provide the customer with the requested report.
  4. National Auto Service PTY LTD reserves the right to choose to not undertake an inspection for any type of vehicle or item, or cancel an inspection, for any reason, in which case the customer will be entitled to a full refund.
  5. National Auto Service PTY LTD will not assemble, erect, dismantle or disturb any part of the structure, fixture, assembly, component or internal/external mechanisms as part of the inspection process. The vehicles condition at the time of inspection is what will be inspected. National Auto Service PTY LTD will not be responsible for aspects of the vehicle that cannot be inspected due to but not limited to such circumstances, the vehicle having a flat battery, the vehicle not containing fuel/oil/ or other fluids. National Auto Service PTY LTD requires that the vehicle be located and assembled on a safe and level surface, with walking distance around the vehicle. In the event that some of these conditions cannot be met you (the purchaser) accept that National Auto Service PTY LTD may not be able to perform a complete inspection.
  6. National Auto Service PTY LTD reserves the right to complete the inspection report components only. Any additional, specific customer requests or comments included in the booking (for additional or specific checks of the vehicle), may be considered, however National Auto Service PTY LTD reserves the right to not complete these additional, for any reasons whatsoever, including requests if they are beyond the scope of the inspection report and/or take a considerable amount of extra time to check or inspect. If the customer (you) would like specific components or parts of the vehicles that is not included in the inspection report an additional fee will apply.

Inspection Process

  1. Following the completion of payment for an inspection, the customer will receive a receipt, this is confirmation of booking. Bookings will be organised at National Auto Service PTY LTD discretion.
  2. All booking times and dates are subjected to change. In the event a vehicle is on auction, the latest a report will be sent to a customer is no later than 2 hours before the close of the vehicle auction.
  3. National Auto Service PTY LTD reserves the right to keep all qualified mechanics details private. Customer details are held on a safe server up to Federal Government standards.

Pre-Purchase Inspection Reports

  1. The inspection of any vehicle undertaken by National Auto Service PTY LTD is a VISUAL mechanical inspection only. National Auto Service PTY LTD will not be responsible for any defects that are discovered following the purchase of the vehicle that were not visually apparent during the inspection. The inspection will cover the items set out in Pre-Purchase/Post-Purchase Report Disclaimer below. No parts or components of the vehicle will be removed during the inspection process. You acknowledge that National Auto Service PTY LTD uses accepted methods to identify faults within a vehicle, and that these methods will not necessarily identify all faults within a vehicle. Customer should make their own educated decision based on the age and condition of the vehicle at the time of inspection, as to whether to purchase.
  2. The report provided by National Auto Service PTY LTD is only current at the time it issued. It is the buyers responsibility (you) to conduct a visual inspection of the vehicle at the point of sale as National Auto Service PTY LTD can only advise on the condition of the vehicle at the time of inspection. This report is NOT a roadworthy certificate and cannot be used as a roadworthy certificate – you should contact the relevant transport authority in your state or territory for road worthy certificate requirements.
  3. National Auto Service PTY LTD is not required to conduct a road test unless possible at the inspection location. Any/all auction houses have their own rules and regulations that National Auto Service PTY LTD will abide by. You accept that in this case some portions of the report may be unable to be completed due to onsite these restrictions. If a road test is able to be done, the vehicle must have adequate petrol and a running battery. National Auto Service PTY LTD will not undertake a road test on any vehicle which appears, as determined by the inspector, not to be in a roadworthy condition, not driveable at the time of inspection for any reason, or if the vehicle is not registered in the relevant state. Vehicles are only road tested to the speed limit of the local area and will not be tested over 60 kms p/h.
  4. You should consider the age and condition of the vehicle at the time of inspection, and any report provided by National Auto Service PTY LTD should be read in context. National Auto Service PTY LTD does not provide any warranties regarding the nature, reliability, accuracy, or completeness, of any information contained in the report.
  5. National Auto Service PTY LTD does not check for any manufacturer recall noticed and it is the customers responsibility to do so.
  6. Notwithstanding the result of any inspection, National Auto Service PTY LTD does not guarantee the vehicle tested will pass a roadworthy inspection.

Your responsibilities

  1. The inspection will be undertaken at the location notified by you (or the relevant vehicle seller) to National Auto Service PTY LTD Inspect. It is your responsibility to arrange for your vehicle to be at the inspection location at the time of the booking or to procure that the vehicle seller makes available his or her vehicle at the inspection location at the time of the booking. 
  2. The report is prepared and provided by National Auto Service PTY LTD to the person who requested the inspection on our booking system. You must not under any circumstances provide the report to any third party.
  3. If the inspection undertaken by National Auto Service PTY LTD is a pre-purchase/post-purchase inspection, the purchaser is responsible for searching public records in relation to the vehicle, for example, if the vehicle has been written off or the VIN or engine number of the vehicle is inauthentic or any other matter. National Auto Service PTY LTD will not be responsible for verifying the accuracy of vehicle mileage as indicated by the vehicles odometer, and is not responsible for determining if it is incorrect or has been tampered with.
  4. You must provide National Auto Service PTY LTD with any material information that you have or that you are aware of in relation to the vehicle which is the subject of the inspection. For example, the vehicle’s service history, if the vehicle is unregistered, any major mechanical repairs undertaken on the vehicle or if the vehicle has suffered structural damage due to its involvement in a collision.  National Auto Service PTY LTD relies on the complete disclosure of this information from you and the accuracy of any such information and will not be responsible if the Report is inaccurate due to any information provided by you being inaccurate.
  5. You understand that the Report is not, and should not be considered to be recommendation to purchase or not to purchase a vehicle. The decision to purchase a vehicle is your own having regard to such matters as you consider relevant having regard to your own circumstances and your own investigations and enquiries.

Liability

  1. Other than as set out in this clause, and to the full extent permitted by law, all rights, remedies, conditions, guarantees and implied and express warranties in respect of any goods or services provided by National Auto Service PTY LTD are HEREBY EXCLUDED.
  2. To the full extent permitted by law, National Auto Service PTY LTD will not be liable to you for loss of use, production, profit, revenue, business, data, contractor anticipated savings or for delay or for any financing costs or increase in operating costs or any economic loss for any indirect or consequential loss or damage. National Auto Service PTY LTD will not be responsible for the terms of any transaction between you and any person in relation to any vehicle inspected by National Auto Service PTY LTD or for resolving any dispute between you and any person.
  3. For the purposes of this section, the term National Auto Service PTY LTD will mean National Auto Service PTY LTD its related bodies corporate and each of their officers, employees, contractors and agents, whether individually or collectively.
  4. You agree to indemnify National Auto Service PTY LTD against any liability, loss, claim or demand if any 3rd-party that National Auto Service PTY LTD works on behalf of such as Gray’s Online (or any of its officers, representatives, employees or agents) suffers any loss or damage or incurs any cost in connection with a breach by you (or any of its officers, representatives, employees or agents) of these terms and conditions.
  5. These terms and conditions will survive the expiration or termination of this agreement.
  6. Intellectual Property: All Intellectual Property Rights in the National Auto Service PTY LTD services are vested in National Auto Service PTY LTD and there is no assignment of Intellectual Property Rights in any materials provided National Auto Service PTY LTD to you as part of the provision of services to you. For the purpose of this clause, “Intellectual Property Rights” means all rights in present and future registered and unregistered copyright, trademarks, designs, patent, semi-conductor or circuit layout rights resulting from intellectual activity in the electronic, industrial, scientific, literacy or artistic fields. National Auto Service PTY LTD retains all rights to the Report and the data contained in it and provides any Report subject to the terms of these terms and conditions.  Nothing in this clause will operate to limit or restrict National Auto Service PTY LTD rights in relation to the data contained in any Report for purposes other than for providing you with a Report. 
  7. Termination: Either party may terminate this agreement by immediate written notice to other if the other party breaches any of these terms that is not capable of remedy or if the other party breaches any of these terms that is incapable of remedy and the other party fails to remedy such breach with 14 days written notice.

Pre-Purchase/Post-Purchase Report Disclaimer

  1. Inspection
    1. This Pre-Purchase Inspection Report (Report) can only take into account the visible condition and the operation of the vehicle at the time of the inspection. National Auto Service nor the inspector will be responsible for any defects that are discovered which were not apparent during the inspection.
    2. The Pre-Purchase Inspection will cover the vehicle’s engine bay, wheels & tyres, brakes, exterior and interior, underbody and a road test (if possible).
    3. Despite all efforts by inspectors, there is no guarantee that this inspection will identify every fault or defect with the vehicle.
    4. The Pre-Purchase Inspection Report is not a certificate of roadworthiness.
    5. In some cases, vehicles may only be inspected in a workshop due to difficulty, size, safety and location requirements.
    6. There are some vehicles that are unable to be inspected, or can only have a limited inspection completed. This may be due to limited access, complexity, or the need for specialised tools and equipment. Should this be the case with your vehicle, we will attempt to inform you prior to the inspection being done, and it will be recorded in the Pre-Purchase Inspection Report.
    7. The Pre-Purchase Inspection is based on the external view of your vehicle and its components. It is not possible to conduct in-depth checks that involve removing, inspecting and re-installing parts due to the time and cost involved. The inspection will include assessment based on noise, operation and performance on the road test. If you wish to have particular parts inspected more closely, you will need to book your vehicle in for that specific part inspection.
    8. Inspectors will inspect the visual condition of components as well as their operation. They will also check the general condition of the vehicle at the time of the inspection
    9. A short road test to assess steering, suspension, brake operation, engine and driveline operation will be conducted.
    10. Some issues do not become apparent unless higher speeds are tested or achieved (e.g. wheel bearings).
    11. Subject to all applicable laws, National Auto Service does not provide any guarantee, warranty or representation regarding the nature, reliability, accuracy or completeness of any information contained in the Report or the fitness of the information contained in the Report for any purpose intended by you. To the full extent permitted by the law, National Auto Service will only be liable to you: (i) pursuant to any guarantee, right or contractual term that arises, is created or is implied by operation of law and that cannot be excluded PROVIDED THAT to the full extent permitted by law, any such liability of National Auto Service is limited, at National Auto Service’s option, to
      1. replacing or repairing the relevant goods
      2. supplying goods equivalent to the relevant goods
      3. supplying the relevant services again
      4. paying the cost of such replacement, repairs or supply, subject always to subclause (xiii) below; or (ii) if Your claim arises from or in connection with any deliberate breach of these terms and conditions or fraud by National Auto Service.
    12. Except to the extent that liability cannot be excluded, National Auto Service, will not be liable to you for claims arising out of or in connection with your access and use of this Report whether arising in contract, tort (including negligence), indemnity, strict liability, breach of warranty or statute.
    13. To the full extent permitted by law, National Auto Service will not be liable to you for loss of use, production, profit, revenue, business, data, contractor anticipated savings or for delay or for any financing costs or increase in operating costs or any economic loss for any indirect or consequential loss or damage.
  2. General Exclusions
    1. All Products listed may not be available in all areas or by all service providers.
    2. This Pre-Purchase Inspection will not tell you everything you need to know about the vehicle.
    3. The Pre-Purchase Inspection will not tell you about defects that have been hidden or concealed. Additionally, problems that only occur intermittently and that are not apparent during the inspection, or problems which cannot be identified by a visual inspection will not be reported.
    4. Inspectors may choose to not remove items such as Baby seats or seat covers during the inspection.
    5. During the inspection, the engine may not be tested through the full operating temperature range. As a result, issues that only become apparent when the engine is cold may not be detected if the engine is presented hot.
    6. Documents that accompany the vehicle (vehicle service records, vehicle manual, damage reports and repair records) will be inspected if available. Preparing these documents is not part of your Pre-Purchase Inspection and their accuracy will not be verified.
    7. The Pre-Purchase Inspection does not check for recall notices issued by the manufacturer of the vehicle.
    8. To avoid damaging the vehicle's drive train, if your vehicle is only equipped with a part time 4WD system, and not designed for full time 4WD, it may not be driven in 4WD during the inspection.
  3. The Pre-Purchase Inspection Report
    1. Only items in the Pre-Purchase Inspection checklist are assessed along with any additions requested by you
    2. We must be notified of any additional items that you request to be inspected at the time of booking.
    3. The inspector will only report on defects apparent at the time of inspection.
    4. Inspectors will provide their professional opinion of the overall visual and operating condition of the vehicle. Any professional opinion provided is a matter of subjective opinion based on the inspectors’ knowledge and experience, with an aim to assist you in making informed decisions.
    5. Although the Pre-Purchase Inspection has been requested to help you make the decision to purchase a vehicle, you must be aware that the Pre-Purchase Inspection report is not a recommendation to either purchase or not purchase the vehicle. You are solely responsible for making that decision, and you must consider whichever factors you see relevant.
  4. Risk to Purchaser
    1. As stated, this Pre-Purchase Inspection is a brief visual and operational check of the components on the vehicle. As there is limited ability to detect hidden or intermittent faults, purchasing a vehicle without warranty from the seller may expose the buyer to risks that could become quite significant.
    2. As it is defined, this inspection will only consider the vehicle in the condition and at the time it is presented. Defects or issues may become apparent, which were not identifiable at the time of inspection.
    3. Standard cancellation fees may apply as per the National Auto Service Terms.
